Districts often need a signed Data Processing Agreement before deploying an app. We’re happy to sign — including state-specific agreements such as those required under New York Education Law §2-d, and standard frameworks like the SDPC National DPA used by many states.
Why our DPA is simple: I Can Tell Time has no student accounts and stores progress on the device. An optional learner name may be typed into the app, but it stays on the device; we don’t receive student emails, rosters, or education records in the ordinary course — so the agreement mostly documents how little there is to protect.
What our standard DPA covers
- Data minimization. No student personal information is required to use the app; an optional learner name and learning progress are stored on the device.
- No sale of data, no advertising. Student data is never sold, rented, or used for targeted advertising or non-educational profiling.
- Limited processing. Anonymous diagnostics (crash and aggregate usage data) are used solely to maintain and improve the app.
- Security. Industry-standard encryption in transit for any data the app transmits.
- Deletion. On-device data is deleted with the app; we honor verified deletion requests for anything else.
- Breach notification. Prompt notification to the district consistent with applicable law.
- Contracting entity and governing law. The contracting party is BURLEIGH CREATIVE YAZILIM VE BILISIM HIZMETLERI LIMITED SIRKETI, a company registered in Türkiye. DPAs with U.S. districts are executed under the district’s state law, and we consent to the jurisdiction requirements of statutes such as NY Education Law §2-d. No student data is stored or processed in Türkiye — or on our servers anywhere.
- Subprocessors. A current list of service providers (e.g., Apple for distribution and payments) is available on request and included in the executed agreement.
